Welcome to Hydaway Collective ("Hydaway Collective," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website located at www.hydawaycollective.com (the "Site"), including any programs, registrations, bookings, communications, and services offered through it (collectively, the "Services"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Who We Are

Hydaway Collective is a Florida limited liability company, operating Hydaway Hollow located at 291 S Wilderness Trail, Ponte Vedra Beach, FL, along with related programs and sub-brands. You can reach us at:

2. Eligibility

You must be at least 18 years old to register for programs, make bookings, or submit forms on the Site on your own behalf. If you are registering a minor child for a program, camp, class, or event, you represent that you are that child's parent or legal guardian and are authorized to agree to these Terms on their behalf.

3. Programs, Bookings, and Registration

  • Program enrollment (including but not limited to Farmstead Mornings, Afternoon Adventurers, After School Guild, Farm to Table Lunch Club, TimberNook, camps, retreats, and events) is processed through our third-party booking platform, Booking Layer, and/or other designated registration links referenced on the Site.
  • Pricing, scheduling, session dates, and availability are subject to change and will be reflected on the applicable program page or booking platform at the time of registration.
  • Payment for programs is processed by Booking Layer or another designated payment processor. We do not directly store your full payment card information. Please review Booking Layer's own terms and privacy practices for details on how they handle payment data.
  • Cancellation, refund, and make-up policies for specific programs will be posted on the relevant program or booking page. By registering, you agree to the cancellation and refund policy in effect at the time of your registration.

4. Communications, Phone, and Text Messaging (SMS)

By providing your phone number through a form, booking, call, or opt-in checkbox on the Site, you consent to be contacted by Hydaway Collective as described below.

4.1 Calls.

We may use call tracking technology to route and record calls made to numbers displayed on the Site for quality assurance, staffing, and marketing-attribution purposes. Calls may be recorded or monitored; if so, this will be disclosed at the start of the call where required by law.

4.2 Text Messages (SMS/MMS).

If you opt in to receive text messages from Hydaway Collective (via a website form, checkbox, or by texting a keyword to us), you agree to receive:

  • Transactional messages — such as booking confirmations, appointment/class reminders, waitlist updates, and account or program-related notices; and/or
  • Marketing messages — such as promotions, new program announcements, and event invitations,
    depending on which opt-in(s) you select. Transactional and marketing text consent are collected separately, and you may opt in to one without opting in to the other.
  • Message frequency varies (e.g., up to [X] messages per month depending on program activity).
  • Message and data rates may apply, depending on your mobile carrier and plan.
  • Consent is not a condition of purchase or program enrollment. You do not need to opt in to text messaging to register for a program or book with us.
  • To opt out of marketing texts at any time, reply STOP to any message. You may continue to receive transactional messages related to an active booking or registration unless you separately opt out of those as described in the message.

  • Carriers are not liable for delayed or undelivered messages.
  • We do not sell, rent, or share your mobile opt-in information or phone number with third parties for their own marketing purposes.

5. User Conduct

When using the Site, you agree not to:

  • Provide false or misleading information on any form, booking, or registration;
  • Use the Site for any unlawful purpose or in violation of any applicable law;
  • Attempt to gain unauthorized access to any portion of the Site or its underlying systems;
  • Scrape, copy, or reproduce Site content for commercial purposes without our written permission;
  • Interfere with the proper functioning of the Site, including call tracking or booking systems.

6. Intellectual Property

All content on the Site — including text, graphics, logos, program descriptions, photographs, and the Hydaway Collective, Hydaway Hollow, and related sub-brand names and marks — is owned by or licensed to Hydaway Collective and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written consent.

7. Third-Party Services and Links

The Site may link to or integrate with third-party services, including Booking Layer (registration and payments), Constant Contact (email communications), and website analytics and advertising tools (such as Google Analytics and Meta/Facebook Pixel). These third parties operate under their own terms and privacy policies, which we encourage you to review. We are not responsible for the practices or content of third-party services.

8. Health, Safety, and Assumption of Risk

Programs offered through Hydaway Collective may involve physical activity, animal interaction, and outdoor activity, which carry inherent risks. Participation in any program is subject to a separate liability waiver and assumption-of-risk agreement, which must be signed prior to participation as required by the specific program. Nothing on the Site constitutes medical advice.

9. Disclaimer of Warranties

The Site and Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Site will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the fullest extent permitted by law, Hydaway Collective and its owners, staff, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or Services, including but not limited to reliance on call tracking, text communications, or booking functionality.

11. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date above reflects the most recent revision. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles.
